Its that time of the year again!
While many of us are out and about shopping or enjoying time with our family and friends, police are out in full force stopping us at DUI checkpoints for no reason and absent probable cause in total violation of the true meaning of the 4th Amendment. These checkpoints are becoming more and more intrusive and police are abusing the permission they have to use them.
These checkpoints are based upon a rotten justification that the 4th Amendment does not apply to DUI and DUI enforcement. To try to govern against abuse, there are many restrictions and points that they have to follow in order for them to be allowed.
The majority of arrests and charges from these checkpoints have nothing to do with drunk driving. Most are non-moving violations, license issues, brake lights etc.
The simple fact is there is a whole lot of money in DUI checkpoints. Police departments get federal grants to set up these checkpoints and police also rake in the profits by handing out citations to drivers. It’s all about money and has nothing to do with safety.
